The Case For Preemption

Peter Pitts is co-founderof the Center for Medicine in the Public Interest and senior vice-president for health affairs at Manning, Selvage & Lee. He makes the case for federal preemption in drug labeling.This isn't to say drug makers should be immune from lawsuits they shouldn't be. Even if the court rules in favor of Wyeth, pharmaceutical companies would still be liable for fraud or other wrongdoing. Americans deserve access to high-quality health care free of avoidable errors. Achieving this requires clear, usable drug labels.
