Allen Iverson Lawsuit
Monday, March 30, 2009 at 08:48AM The D.C. Circuit affirmed a decision of the district court holding the appellants liable to appellee Godfrey
for injuries he sustained in a nightclub brawl. The district court found that appellant Iverson liable for negligent supervision of his bodyguard, who was found liable to Godfrey for assault, battery, and intentional infliction of emotional distress. The court held that the district court did not err in ruling that the jury did not need the assistance of expert testimony to determine the standard of care Iverson owed to Godfrey when the record evidence supported the jury's finding that the bodyguard attacked Godfrey in a fight that lasted for several minutes and that Iverson stood and watched without attempting to do anything to stop the beating.
"It's dignity and respect, responsibility and accountability," said Greg Lattimer, the plaintiffs' attorney. "These men were forced to suffer a huge indecency. They were attacked by Mr. Iverson's group not for who they are or what they did, but because they didn't move fast enough so that Mr. Iverson and his group could have the space they wanted."
