The Vioxx settlement, or we should say the potential Vioxx settlement, has several issues that will be of continued interest and discussion to trial lawyers and others nationwide. The first big stumbling block is the ethical argument that was created by the defense provision that seems to require trial lawyers to actively lobby to get all of their clients to settle under the current terms of the deal, and then to agree to not represent any clients that fail to agree to settlement. This is one of the most contentious issues in the entire Vioxx agreement and one that will likely be litigated by various attorneys or brought up for discussion before various bar ethics groups in the next few weeks.
The second major issue is going to be the subrogation and medical liens that need to be resolved prior to settlement.
